Federal Judge May Unseal Controversial FBI Search Warrant for Clinton Emails

The controversy over FBI Director James Comey’s announcement of a new review into Hillary Clinton’s private email server just 11 days before the recent presidential election moved into federal court Tuesday with a hearing focused on the search warrant that gave FBI agents access to Clinton emails found on the computer of Anthony Weiner, the former congressman and husband of a top Clinton aide.

Los Angeles lawyer E. Randol Schoenberg, best known for recovering Jewish-owned art looted by the Nazis, hired lawyers to file a lawsuit last week in an attempt to unseal that search warrant and related affidavits….


“Access to the search warrant is critical for the public to learn the basis for the reopening of the investigation to ensure the FBI acted in a manner consistent with its constitutional obligations under the First Amendment,” the suit says.

On Tuesday afternoon in a courtroom in downtown Manhattan, federal judge Kevin Castel said he may make public the search warrant and related documents from the search of Weiner’s computer….


Castel gave the government just two days to file papers arguing why the search warrant and related documents should stay sealed and told Schoenberg’s lawyers to send a copy of the lawsuit to Clinton, Weiner and Abedin.

Last week, E. Randol Schoenberg filed suit to see the warrant to examine Anthony Weiner’s laptop for Hillary Clinton’s emails.  Now a federal judge has responded to that request and is requesting the warrant.

A federal judge directed the U.S. government Tuesday to show him any search warrant application used to gain access to a new batch of Hillary Clinton‘s emails just before the election.

Judge P. Kevin Castel asked a government lawyer to turn over any pertinent documents by late Thursday in case he decides any portion of the materials must be made public. He also recommended the government advise what redactions are necessary should he rule that portions of documents must be disclosed publicly.

E. Randol Schoenberg, a Los Angeles-based lawyer who specializes in recovering works of art stolen by the Nazis, sued to obtain any search warrant and related papers used by the FBI to obtain the emails from a computer belonging to Anthony Weiner, the estranged husband of Huma Abedin, one of Clinton’s top aides. Schoenberg’s lawsuit followed a Freedom of Information Act request for the documents.

Weiner, a Democrat, resigned his seat in Congress after sexually explicit texts and social media posts to various women. He is under investigation by federal authorities for online communications he had with a 15-year-old girl.

In 2010 and 2012, Bill Clinton, as surrogate for Hillary, campaigned for Democrats who supported her in 2008 while she, as secretary of state was unable to participate in politics.  Newly freed of that status, however,  Hillary Clinton’s is the endorsement many would love to claim.  In California a few weeks ago to pick up an award, Bill Clinton endorsed and did a bit of campaigning for Los Angeles mayoral candidate Wendy Greuel, a Clinton Dem who is running against Obama Dem Eric Garcetti, while neatly excusing Hillary from stepping into the fray.

If friends on the other coast are benefiting from Clinton charisma, those in New York, with whom an exhausted Senator Clinton expected to reacquaint herself following her 2008 presidential primary and subsequent campaign for the Obama-Biden ticket, will not be receiving any Clinton endorsements during the mayoral primary in New York City.

With Anthony Weiner’s expected entry into the mayoral campaign possibly today via a video shot on his childhood front stoop with his wife Huma at his side, both Clintons have declined making  NYC endorsements citing too many friends in the race.

The Clintons will keep mum in the Democratic primary for mayor.

Former President Bill Clinton and former Secretary of State Hillary Clinton have personal histories with several contenders in the packed race.

hrc and wjc image.jpgBut their tandem statements come as Anthony Weiner, husband of longtime Hillary Clinton aide Huma Abedin, is widely expected to go to the videotape in launching a redemptive comeback.

“President Clinton has too many friends in this race who have been good to him and his family,” spokesman Matt McKenna told the Daily News. “He wishes them all well, but won’t be getting involved.”

Nick Merrill, a spokesman for the former First Lady and senator, similarly said “Secretary Clinton knows all of the candidates, she has worked with many of them, and is close with many of them, so won’t be weighing in one way or the other.”

So while it is clearly a political advantage to be able to claim the power couple as friends,  nothing guarantees their support in a campaign,  even when you are married to their surrogate daughter, your wife  has worked for them, and  the former president performed your marriage ceremony.  Sometimes the field is simply too fraught.

I am probably the last Hillblogger to put up this story today, but I must for the record because it is just too sweet. As everybody the whole world over must know by now, NY (D) Rep. Anthony Weiner, a Clinton friend, married Hillary’s assistant, Huma Abedin today on Long Island. The cutest part is that Bill Clinton performed the ceremony. Here is the AP story.
